Please read these Terms and Conditions ("Terms") carefully before using the Presenly application (the "Service") operated by PT Wahana Digitama Semesta ("us," "we," or "our").
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service — including employees of organizations using Presenly.
2. Registration and Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
Tenant Admin Accounts
If you register on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms. You are responsible for maintaining the confidentiality of admin credentials and for all actions taken under your tenant.
Employee Accounts
Employee accounts are created and managed by tenant admins. Employees agree to use the Service only for the attendance and workforce-management purposes for which it is provided.
3. Subscription and Payment
The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either monthly or annually depending on the type of plan you select.
Auto-Renewal
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it before renewal or we cancel it.
Free Trials
A 14-day free trial may be offered for the Pro plan. No credit card is required during the trial. At the end of the trial, if you do not select a paid plan, your account will revert to a read-only state until either upgrade or deletion.
4. User Responsibilities
You are responsible for all data and information you input into the Service, including the personal data of your employees. You represent and warrant that you have all necessary rights and consents to provide such data.
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to circumvent attendance verification (mock GPS, face spoofing, buddy-punching).
- Reverse-engineer, decompile, or attempt to extract source code from any Presenly app or API.
- Resell or repackage Presenly to third parties without a written reseller agreement.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of PT Wahana Digitama Semesta and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Customer data — attendance records, employee profiles, schedules — remains the property of your organization. We process this data only to provide the Service.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason — including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
On termination, you may export your data within 30 days using the data-export tool in admin settings. After 30 days, data may be permanently deleted from our servers.
7. Limitation of Liability
In no event shall PT Wahana Digitama Semesta — nor its directors, employees, partners, agents, or affiliates — be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict-of-law provisions. Any dispute will be resolved in the competent courts of Jakarta.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any material change taking effect. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms.
